1. Definitions
“Sponsor” means Viviscent Wellness Foundation (VWF). “Entrant” means any eligible participant. “Prize” means Lease‑to‑Own Sweepstakes Rental occupancy rights.
“ARV” means approximate retail value. “Trust” means the irrevocable trust holding title for winner’s benefit. “Equity Credits” means non‑transferable program credits
accrued during occupancy, redeemable only upon voluntary move‑out/transition. “Gross‑Up” means taxes paid by VWF and treated as additional prize value. “Primary Residence”
means the property the winner occupies as their principal home.
2. Program overview
This national sweepstakes awards long‑term occupancy rights in a designated VWF property under a lease of up to thirty (30) years. VWF retains title under bylaws; properties
are held in irrevocable trust for the winner’s benefit to protect residency and equity accrual. Equity credits are non‑transferable, non‑assignable, have no cash value outside
the program, and cannot be sold, pledged, or inherited.
3. Eligibility
- Age/residency: Legal U.S. residents, 18+; void where prohibited, including PR, GU, AS, VI.
- Exclusions: VWF employees, board, contractors, administrators, and immediate households are ineligible.
- Verification: Sponsor may require proof of identity, age, and residency; failure results in disqualification/forfeiture.
4. Entry period
- Start: January 1, 2026, 12:00 AM ET.
- End: [Insert End Date], 11:59 PM ET.
- Receipt: Online entries due by End Date. Mail‑in entries postmarked by End Date and received within seven (7) days thereafter.
5. How to enter
- Paid entry: Purchase tickets via viviscentwellnessfoundation.org (final, non‑transferable).
- AMOE: Mail a postcard (3"x5" or 4"x6") with full name, mailing address, phone, and email to:

- Unlimited entries: Multiple tickets/postcards allowed. Each postcard must be mailed separately in its own envelope. AMOE entries have equal odds.
- Integrity: Automated, bulk, or bot entries are prohibited. Incomplete, illegible, or tampered entries are void.
6. Prize description and value
- Prize: Lease‑to‑Own occupancy rights under a lease of up to thirty (30) years.
- Residency: Must be primary residence; subleasing, transfers, rentals, or sale prohibited.
- Ownership: VWF retains title; property/home held under bylaws and in trust for winner’s benefit.
- Maintenance: VWF maintains structural elements/common areas; winner handles routine care and cleanliness.
- Equity credits: Accrue during occupancy; redeemable only upon voluntary move‑out/transition; no cash value outside program.
- ARV: $100,000 (1‑BR); $150,000 (2‑BR), determined by fair market rental value and independent appraisal; used for IRS reporting and may differ from market value.
- Substitution: Sponsor may substitute a prize of equal/greater value if circumstances beyond control make the prize unavailable.
7. Winner selection and notification
- Method: Random drawing from eligible entries; may occur publicly and/or be recorded.
- Odds: Depend on total eligible entries nationwide.
- Notice: Email, phone, and/or certified mail; winner must respond/completely document within forty‑five (45) days.
- Alternate: Non‑response/incomplete documentation results in forfeiture and an alternate winner.
8. Taxes, fees, and IRS reporting
- Taxable prize: Occupancy rights constitute taxable income. Sponsor issues IRS Form 1099‑MISC for ARV and any taxes/fees paid on winner’s behalf.
- Withholding: For prize values > $5,000, 24% withholding may apply. Any gross‑up taxes paid by Sponsor are additional prize value and reported.
- W‑9: Winner must submit IRS Form W‑9 prior to occupancy; failure within forty‑five (45) days results in forfeiture.
- Winner taxes: Winner is responsible for all federal, state, and local taxes not expressly paid by Sponsor.
9. Trust and lease‑to‑own structure
- Irrevocable trust: Properties are held in irrevocable trust for winner’s benefit.
- No title: Trust safeguards residency/equity credits but does not confer title; VWF retains deed ownership under bylaws.
- Equity reporting: Equity credits recorded annually and disclosed in writing to winner.
10. Publicity and media rights
- Consent: Entrants grant Sponsor the right to use names, likenesses, voices, and narratives for promotional, educational, and fundraising purposes without additional compensation, where lawful.
- Dignity: Sponsor commits to respectful representation.
11. State sweepstakes registration and bonding
- FL: Registration and surety bond required for ARV ≥ $5,000; filings (rules, bond, trust/escrow) completed ≥ 7 days before start.
- NY: Registration and surety bond required for ARV ≥ $5,000; register ≥ 30 days before start; winners list filed ≤ 90 days post‑close.
- RI: Registration required for retail sweepstakes with ARV ≥ $500 (if entries accepted at retail). Bond not required.
12. Charitable solicitation registration

Compliance operations: Sponsor will maintain annual renewals, audited financials where required, and registered agents in each jurisdiction; exemptions and limited filings will be monitored and updated as laws evolve.
13. Dispute resolution
- Arbitration: Binding arbitration administered under American Arbitration Association (AAA) rules.
- Venue: Walker County, Alabama, unless otherwise required by law.
- Class waiver: Class actions are waived; disputes resolved individually.
14. Federal law compliance
- FTC: Sponsor complies with federal advertising/sweepstakes guidance.
- IRS: Sponsor complies with prize reporting requirements.
- USPS: Sponsor complies with mail‑in entry regulations.
15. Accessibility and non‑discrimination
Sponsor does not discriminate on the basis of race, color, religion, sex, national origin, disability, veteran status, or any protected category. Reasonable accommodations will be provided to ensure equal access for individuals with disabilities, consistent with ADA requirements.
16. Winners list and transparency
To obtain a winners list, mail a self‑addressed stamped envelope to the Sponsor address. Requests must be received within 90 days of sweepstakes close and are available only to U.S. residents.
17. Insurance and liability
- Coverage: Sponsor maintains organizational liability insurance for activities related to this program.
- Renter’s insurance: Winner may be required to maintain renter’s insurance naming Sponsor/additional insured as applicable.
- Limits: To the fullest extent permitted by law, Sponsor disclaims liability for indirect, incidental, consequential, punitive damages, and events beyond reasonable control.
18. Governing law, severability, non‑waiver, and entire agreement
- Governing law: All issues concerning construction, validity, interpretation, and enforceability of these Rules are governed by the laws of the State of Florida and applicable federal law.
- Severability: If any provision is held invalid or unenforceable, the remainder remains in full force and effect.
- Non‑waiver: Failure to enforce any provision does not constitute a waiver of future enforcement.
- Entire agreement: These Official Rules constitute the entire agreement between Sponsor and participants, superseding prior communications.
